Conditions of use of the online reservation service with prior authorization<\/h1>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

These Terms of Use supplement the General Terms of Sale of the Skina restaurant (hereinafter, the \u201cRestaurant\u201d). These Terms of Use shall prevail in the event of a conflict between the latter and the General Terms of Sale.<\/span><\/p>

The Restaurant implements a reservation service with prior authorization by means of a bank deposit (hereinafter, the \u201cReservation Service with prior authorization\u201d), which allows the management of the reservation of a table for a date and time indicated by the client (hereinafter, the \u201cClient\u201d or \u201cYou\u201d), as well as the consequences in the event that the client does not show up or if the client cancels or modifies said reservation outside the established time periods for this.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t

1. DESCRIPTION OF THE BOOKING SERVICE WITH PRIOR AUTHORIZATION<\/p>\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

The Restaurant provides the Reservation Service with prior authorization, whereby the Restaurant blocks a bank deposit using the bank card. This bank deposit allows the bank to pre-authorize the charge.<\/span><\/p>

The Restaurant has established a fixed amount of bank deposit for each booked guest. This amount is indicated at the time of booking.<\/span><\/p>

This pre-authorisation does not constitute payment for the meal. Payment for the meal will be made exclusively on site. The Reservation Service with pre-authorisation is only a guarantee for the Restaurant, which does not charge any sum at the time of the reservation.<\/span><\/p>

However, if the Client does not show up, or cancels or modifies the reservation after the deadlines established for this, the indicated bank deposit will be used and the amount will be charged to the Client’s bank account. This charge will be made within seven (7) days from the date of the meal.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

2. INFORMATION REQUIRED FOR BOOKING WITH PRIOR AUTHORIZATION<\/p>\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

For reservations made through the Restaurant’s website, the Customer will be asked to provide the following mandatory data:<\/span><\/p>

– treatment;<\/span><\/p>

\u2013 surnames;<\/span><\/p>

– name;<\/span><\/p>

– birthdate;<\/span><\/p>

\u2013 email address;<\/span><\/p>

\u2013 mobile phone number;<\/span><\/p>

\u2013 bank card holder (compatible cards: VISA and MASTERCARD);<\/span><\/p>

\u2013 bank card number;<\/span><\/p>

\u2013 expiration date;<\/span><\/p>

\u2013 security code.<\/span><\/p>

The entire process associated with the Pre-Authorization Reservation Service is protected (the form is provided on a protected website and a banking security protocol is used).<\/span><\/p>

In order to use the Reservation Service with prior authorization, it is mandatory to provide this data. You will not be able to reserve a table at the Restaurant if you do not provide the requested data.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

3. FIGHT AGAINST FRAUD; BANKING AUTHORIZATION LIMIT: RIGHT NOT TO VALIDATE THE RESERVATION<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

All pre-authorisation transactions carried out through the Pre-Authorisation Reservation Service are subject to the control of a fraud monitoring tool. In this context, the Restaurant may be obliged to block the pre-authorisation. The Restaurant also reserves the right to cancel any reservation if it has reasonable grounds to consider that it is fraudulent, abusive or constitutes any illegal activity, even if the fraud monitoring tool has not blocked that reservation.<\/p>

Furthermore, the Client’s bank may reject the pre-authorization transaction due to the bank card usage limit established by said bank, even if the bank account does contain the funds necessary for the pre-authorization reservation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

4. CONFIRMATION OF THE CUSTOMER'S RESERVATION<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Once the Restaurant has confirmed the reservation, you will receive an email or SMS containing the details of the reservation (location, date, time, number of guests and amount of the bank deposit). It is important that you check the details in the message and inform the Restaurant as soon as possible of any omissions or errors.<\/span><\/p>

In case you do not receive the aforementioned confirmation by email or SMS, it is important that you contact the Restaurant to obtain it.<\/span><\/p>

5. CONDITIONS FOR MODIFICATION OR CANCELLATION OF THE RESERVATION AND EXECUTION OF PRIOR AUTHORIZATION<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

In the event that, without having previously cancelled the reservation within the time periods indicated below, You do not show up on the date and time indicated in the reservation and, at the latest, fifteen (15) minutes after the time indicated for the reservation, the Restaurant will charge You the amount corresponding to the amount of the bank deposit, multiplied by the number of diners reserved (one diner equals one person).<\/span><\/p>

You can cancel or modify your reservation up to 24 hours before the meal time. After that time, the Restaurant will charge you the amount corresponding to the amount of the bank deposit multiplied by the number of diners booked (one diner equals one person).<\/span><\/p>

The charge to the indicated bank account will be made within seven (7) days from the date of the meal whose reservation has not been respected.<\/span><\/p>

Since the company La Fourchette SAS is the one that has provided the Restaurant with the Solution, the name of this company will appear on the bank statement if the charge is made to your bank account.<\/span><\/p>

Please note that any modification to a reservation is subject to the Restaurant’s availability of diners. If the modification of a reservation is not possible due to the Restaurant’s availability of diners, the latter will offer the Client the possibility of cancelling the reservation.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

6. ABSENCE OF RIGHT OF WITHDRAWAL<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Pursuant to Article L221-28, 12\u00b0 of the French Consumer Code (Code de la consommation), you do not have any right of withdrawal with respect to the provision of catering services on a given date or within a given period.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

7. APPLICABLE LAW; CONFLICT MANAGEMENT<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

To the extent permitted by law, these Terms of Use shall be governed by French law.<\/span><\/p>
